2. The applicable scope of the Agreement
The Agreement is applicable on all the related services and tools taken in the database system of Total Credit China.

3. The alteration and amendment of the Agreement
Total Credit China has rights to make alteration and amendment on the Agreement when it's regarded as necessary. Once there is any alteration of the Agreement, Total Credit China will publicize the alteration contents on its website. This will become effective from the publication date. If you continue to use Total Credit China's related services, you will be regarded as acceptable with the alteration of the Agreement; if you don't agree with the Agreement after alteration, you must raise your demand initiatively and at once of stopping accept the service.

4. Serving objects
As per the stipulations of Total Credit China, our services are only provided to the units who accept the stipulations of the Agreement and with legal person qualifications, as well as the individuals who have whole civil action capacity. At the same time, Total Credit China has rights on deciding at any moment to refuse to provide services to any individual or unit if we consider it's reasonable.

5. Service Scope and Explanation

c. Keep well your personal registry name, account number and password;
Note: Total Credit China ask you to keep well your personal registry name and password. In any case you reveal your registry name and password due to your personal reasons, and all the aftereffects caused by this will be complete responsible by yourself. At the same time, if you find out that anyone use your registry name or password without your authorization, or any other circs that disobey secrecy stipulations happen, please inform us at once to settle it urgently; please insure that you exit the website in correct process when you operate on website every time. Total Credit China won't be responsible for any loss due that you can't obey the stipulations of the Agreement.

8. Customers type and Charges

The customers of Total Credit China are divided into 2 types: Customers free of charge and payable.

Thereinto customers free of charge can utilize part of service in total Credit China, such as browse the info for free (not the whole content); payable customers can use the whole service contents that total Credit China provide.

9. Customer's obligations

a. When you utilize our service, you must obey"PRC Secrecy Law", "PRC Copyright Law", "Secrecy Administration Stipulations for Computer Info System on Internet","PRC Security Protection Byelaw on Computer Info System", "Security Protection Administration Measure for Computer Info network on Internet", "PRC Temporary Stipulations for Computer Info Network on Internet" and implement measures, as well as any or all the stipulations of related laws.
Note: If Total Credit China has sufficient reasons to consider that your action maybe disobey related laws, codes, rules or byelaws, we can terminate to furnish you with the service at anytime without informing you in advance.

b. Stipulations on your data:

(a) The info that you furnish with Total Credit China must be true, complete and efficient;
(b) Can't deal with fraud, forgery, brigandage and other crimes;
(c) Can't Damage the third party¡¯s rights and interests, such as substance right, or copyright, patent, trademark, commercial secret and other knowledge property right, intimacy right, honor right, etc..
(d) Can't disobey any laws, codes, byelaws or rules (including, but not the laws, codes, byelaws or rules only on the criterion of export administration, trade quota, protecting the consumers, malfeasance competition or false advertisement.
(e) Can't contain any contents of slander (including commercial slander), insult, threat or illegal annoyer.
(f) Can't contain any contents of bawdry, violence or enfant eroticism.
(g) Can't contain any virus, pretending destroy program, computer worm, timing program bomb or other computer program that have malice to destroy, disturb, intercept secretly or break into any system, data or personal info.

10. Customer's intimacy system

Our company promises that without your legal authorization, we won't open to public, edit or disclose your registry info and un-open contents that you save in Total Credit China, except the following circs:
a. As per the stipulations of relevant laws or Total Credit China's legal service process
b. In case of emergency, to maintain your and public rights and benefits;

Total Credit China don't ensure that our service can certainly satisfy the customers' usage demand, nor ensure that the service can't interrupt, be on time and safe, and without any mistake; we also don't ensure that the security and veracity of the service, as well as the nicety, trustiness of the results obtained at last.
b. Total Credit China aren't responsible for all the charges born by the quality, safety, service and legality through the course of transaction between you and other customers, as well as the authenticity, veracity, integrality of the commercial info. We aren't responsible for whether the various parties in the transaction carry out their relevant obligations in the trade agreement, either.
c. e. Referring the force majeure, including natural disasters, strike, turbulence, shortage of materials, rebellion, war, government action, communications, other establishment trouble, as well as all the factors of force majeure, which lead total credit China to delay or can't carry out the Agreement, total Credit China don't bear any responsibility and its lost.

D. Knowledge Property Right and other rights of Total Credit China

12. Knowledge Property Right and other rights of Total Credit China

a. Total Credit China have relevant rights for the services and the data under the protection of Knowledge Property or other laws, which are contained in the software used in the service.
b. The data & info and the contents transmitted by the service are protected by Copyright Law, Trademark Law, Patent Law or other laws; without the definite authorization and permission of Total Credit China, the customers can't copy, amend, lease, spread or derive from other productions, or utilize them for commercial intention.
c. The typeface of Total Credit China, as well as the design, identifier, products and its service name are all the trademarks which belong to Shandong Total Commercial Credit Management Co., Ltd.. Nobody can use, copy or use them as other purpose.

E. Others

13. Notification

Except other definite stipulations, all the notifications from Total Credit China are sent by e-mail means. It's e-mail address is chinatcm@public.qd.sd.cn. 24 hours after the e-mail being sent, the notification is regarded as being delivered. Besides, our company will also send the notification by the means of posting registered letter with post fees paid in advance to your designated address, and need your return receipt. 3 days after the date of the letter being posted out, the notification is regarded as being delivered.

14. Compensation

If you disobey the Agreement or the other stipulations which are mentioned here and brought into the Agreement, or you disobey the laws and infract the third party¡¯s rights, which cause the third party raise their compensation demand to Total Credit China, as well as its subsidiaries, branches, directors, staff members and agents (including legal costs and other professionals¡¯ charges), you must compensate Total Credit China, as well as its subsidiaries, branches, directors, staff members and agents for their economic lost and reputation lost.

15. Relation Cognizance

Being registered customer, you are only independent contractor with Total Credit China. There are no relations of form or set up any agent, partnership, co-management, hire and being hired, guarantee and being guaranteed, license authorization and being authorized.

16. Other stipulations

The Agreement forms the whole agreement between you and Total Credit China. It stipulates your usage of the service, and replaces any previous written or oral agreements concluded between you and Total Credit China. The contents of the Agreement are restricted by PRC¡¯s laws. In case the service terms of the website collide with PRC¡¯s laws, the terms will be totally re-explained as per the laws¡¯ stipulations, and other terms remain efficient in law and effective to the customers.

Note: In case Total Credit China don¡¯t take action against certain disobeying-agreement actions of you or other persons, it doesn¡¯t indicate that Total Credit China will give up the rights of taking action against any further or allied disobeying-agreement events.
